Statewide Rules (Apply to All CA Cities)

  • No added parking required when an ADU is within ½ mile of transit, is a conversion, or meets another statutory exemption; otherwise cities may require up to 1 space per ADU or bedroom (AB 68 / Gov Code §66314)
  • No owner-occupancy required for detached ADUs (AB 976); AB 1154 also drops it for JADUs with a separate bathroom (shared-bath JADUs still require it)
  • 60-day deemed-approved — SB 543 (Jan 2026): if city fails to act in 60 days, ADU is automatically approved; HCD can render a non-compliant local ADU ordinance null and void
  • Impact fees waived for ADUs under 750 sq ft
  • Up to 1,200 sq ft for detached ADUs; 500 sq ft for JADUs
  • 4 ft setbacks for structures up to 16 ft height

  • SB 543 (Jan 2026): Deemed-approved provision — ADU auto-approved if city misses 60-day deadline
  • AB 1154 (Jan 2026): Owner-occupancy requirement removed for JADUs
  • SB 1211 (Jan 2025): Up to 8 detached ADUs on multifamily lots (was 2)
  • AB 1033 (2024): Cities can opt-in to allow separate sale of ADUs as condos
